The law changed in 2014 that a support payer can be reassessed up to 3 years prior. It happened to me. I've never missed a payment and thanks to this amended law, I now owe $10K in back support. I have proof that she was ok with payments (thru FRO) that I've been making but that didn't matter. Harsh reality: you can NEVER trust your baby mama. Good luck bro! Keep on fighting!

   

Sure as fraud she can do this. I had a judge make me arrears based o the argument I wouldn't help her rip off the child subsidy program in mb. Keep your receipts.

   

I hope the best for you and always best to deal with things outside of court, maybe you can find a way to work it out. Courts and lawyers don't get payed to fix problems on prolong them

   

If you have the agreed-upon no support payments in writing then she doesn’t have a leg to stand on.

if you have it in writing that you agreed you don’t have to pay support and you only pay the extras for 50-50 custody … And you believe she makes more than you… She’s going to have quite the case when it goes back to court.

   

Sadly she can go back and file for it. The system is a mess and it almost killed me. Good luck brother.

   

I believe the court will take into consideration the status quo. Be preemptive, take her to court to amend the order to reflect the agreement you both made and adhered to.

Unless she files for hardship they only look at your tax assessments.
