He has to get a lawyer right away and get the lawyer to be ready to seek the immediate return of his infant to himself or a family member and he needs to have a lawyer that will argue it on the date of court which should be within 5 days of having the child apprehended. They will argue to keep the infant from the mother and father because of the outstanding warrant for his girlfriend and the breaches that occurred between them because of their history of domestic violence. The only best option is to provide a family member with no involvement with CAS and no criminal history to state that they are ready and able to care for the infant and to have pictures given to lawyer showing that have bought a crib, diapers, clothing,etc in preparation for the infant and that they have ample space in their home. The lawyer has to be ready to argue the return of the infant or ask for adjournment within a week to return to argue. The society will argue that they need to do kinship assessment that will take time trying to buy time to get temp care custody and then it will be harder to get child from them.


sorry, i forgot to mention for him to get the worker to do an home assessment of the family member's home preferably before the court date because the judge will want to know if home has space and crib for baby and that the society has no concerns about the home.
