I’m a 38 yr old divorced father with equal shared parenting time. The problem I find is with my ex’s tax return; in both its fraudulence and the proof it provides to my suspicions. Back info: daughter 12, son 10. We have children one week on one week off or 50/50. I live walking distance to children’s school. Children are both well “trained” and prepared to spend time at home alone. Daughter has babysitting course and son a stay at home alone course. I live in a basement suite with the friendly landlord lady living upstairs. The ex is 35 & a server. Her “rich” father bought her a 3bedroom townhome a short 5-10 minute drive away; there’s no way she pays rent or mortgage despite their claim she pays $1000/month. Upon looking at the income info she provided, she’s claiming a mere $9,850 in wages from the restaurant, and $3,480 on line 104 (other employment income). I assume that is “tips”. Upon doing some research on minimum wage and applying simple math calculations, hers what this says about her work year: Hours worked per week: 16.98 Hours worked per weekday: 3.396 Tips made per hour: $3.94 I’ll start with how under employed she has made herself. This is ludicrous. She has no excuse not to work at least full time hours on her 7 day week without the children. And can easily work a full time job on her parenting time week as the children can be at my residence both before school and after school, wether I am home or not. And it’s FREE “child care” as well. Secondly, she clearly is not claiming 100% of her tips. I have worked in the industry in my younger years and know very well this is fraudulent. Based on the fact she serves at a popular tap house in Surrey BC, I calculated as follows: Table turn over every hour approx 2-3 tables an hour of 2 people 4-6 people an hour X 17hrs/wk=68-102 people/bills a week Average persons bill $18.00 Average tip 15%=$2.70 tip on 1 person bill 68x2.70=183.60 to 102x2.70=275.40/wk $183.60-275.40tips/wk X52weeks=$9547.20 - $14330.80 yearly Has anyone else in this group experienced this and how did they challenge it? Is there any advice I can receive on how to get a judge (Supreme Court based on our divorce proceedings) to impute an income on her?
